"" A father who arranged for his 12-year-old
daughter to marry and have sex with a 26-
year-old university student, resulting in her
falling pregnant, has been jailed for at least
six years.
"His role was to protect her, not put her into a
relationship where she was at risk of
pregnancy at the age of 12," Judge Deborah
Sweeney said in sentencing the 63-year-old in
the Downing Centre District Court on Friday.
"That this man thought his actions were
justified by his religious faith does not excuse
what he did," she said.
The father, whose name is suppressed to
protect his daughter's identity, was convicted
on April 1 of "intentionally procuring a child
under 14 for unlawful sexual activity" and for
"inciting" and "encouraging" this activity to
take place.
The court heard that the father was concerned
that, once his daughter began showing an
interest in boys, there was a risk she would
have sex outside marriage, which he believed
was a sin under Islamic law.
He felt that a "solution" to this problem was
for his daughter to get married so that she
would not be living in sin if she had sex.
When the university student approached the
father at a Muslim prayer meeting in 2013 and
said he wanted to marry the man's daughter,
the man arranged for the pair to meet and to
swap phone numbers.
Some months later, against the strong
objections from the girl's mother, the father
arranged for his daughter to marry the student
in an Islamic ceremony at his home in the
Hunter region of NSW.
He then encouraged the pair to
consummate the marriage, and told his
daughter not to use contraception or to let her
new husband do so either.
"When the child and the man returned to he
offender's home for the first time after being
married, he made available to them a
bedroom," Judge Sweeney said.
"He removed the two single beds and left two
single mattresses in the room. The two had
sexual intercourse together twice during that
weekend.
"By this conduct, allowing them to stay in his
house and stay in the same room, the offender
made it more likely for them to have sexual
intercourse."
About 18 months after the "marriage" the 12-
year-old became pregnant.
It was an ectopic pregnancy that resulted in a
